Default Domain Transfer Agreement

Unfortunately when I bought a domain (airlinemogul.com) I didn't bother buying the .net and .org aswell. These were subsequenty bought up and redirected towards what would be a competitors site. After a significant period of time I managed to get an agreement to transfer the domains to my ownership. But the other person stuck in a very random clause as he accused a member of my website of circulating false rumours. I was concerned about the wording of the following:

Both parties agree to maintain good relations in the future among their web projects ("XXX" and "YYY"). Both parties agree that the staff members or other persons involved in the creation or administration of the before mentioned web services do not intentionally post false, incorrect or otherwise harmful or malicious statements that are related to the web service of the other agreeing party to their websites and/or discussion forums.
The fact that in order to get the domains transferred over, I need to maintain good relations is a bit much in my opinion. That if there was ever a disagreement there would be implications for the domains? Could anyone suggest a better approach to the above quote which would prevent the need for "good relation" or something a bit more logical?

If you are paying for the domains that clause is ridiculous.

Do you have rights in the name in question?

I have the name registered as a business name with the CRO. (Airline Mogul) And yes I am paying for the domains. When I said I didn't want to sign the agreement and seek legal advise the other person immediately said to change it to whatever I wanted. I think he realises its not something that is supposed to go in there either.

I'm not a solicitor, so I'd recommend you speak to one, however I wouldn't be happy signing anything with that sort of clause in there. I don't see how my purchase of goods should be dependent on some fluffy business relationship thing

Any recommendations on a firm that would be good in this situation? I was given a few for intellectual property but have yet to contact them about one of my projects...

Well I let the domains expire as opposed to enter that agreement. The domains were bought up and have the usual ads now sitting on them, would the likes of $60 from GoDaddy to negotiate purchase of a domain be regarded as too much? Is there a better deal available elsewhere?

Agreed.

How much do you think the solicitor would have charged you for a consult?

I'd buy them before someone else reads this and realises that they are very valuable (to you at least).

I think he's talking about paying $60 to Godaddy to try and broker the sale, not buying the domains for $60.

If it's the first option, I'd avoid Godaddy.
