I would guess so while you do something with the domain ?

also I would assume you could be using the domain for email ? so its not necessary that you have a website

A lot of domains that are in active use may appear to be parked - it doesn't mean that they are. It just means that they're being used for email or that there are services associated with subdomains

though if the domain is one that another party may be interested in, and if an appeal is made for them to claim it, surely it wont look good if the domain is parked?

I'd love to own hosting.com - that doesn't mean I have any right to it.

The only way that the domain usage can come into play is if trademark and / or other intellectual property rights come into it.
