Default Penalised Penalised Duplicate Content vs Filtered Duplicated Content

Hi guys,
I had a bit of a discussion with a friend today about duplicated content. We each have differing thoughts on it. I'm hoping that a few members here can row in with their knowledge on the matter of duplicated content.

I'm saying that when duplicated content is detected by a bot, the content is filtered. Google/Yahoo give a priority to the site which it thinks created the original content. Site B, which copied Site A's content, does not get penalised immediately but the content will become filtered and won't appear in the SERPs.

Is that as close to correct?

On the same note, what factors do the SE's consider when trying to determine if a site has copied another site's content?

AFAIK there's nobody claiming duplicate content causes a penalty though how they determine the "original" and what exactly they filter remains a bit up in the air.
