A Spanish estate agent has ripped my clients site (XHTML, CSS and design) and, after sending them an unsuccessful cease and desist email to the estate agent and the web company (in English that they may not have understood), I'm considering legal recourse. However, I'll be really hacked off if I have to spend a fortune on this simply because someone else stole my client's design/code.

Can anyone recommend the least expensive route to go down that might have an impact? Would it be reasonable to assume that I would get my legal costs back if I won? Would this come under European laws or Irish? Any advice would be much appreciated.

Is it a .com or a .es?

As far as I know, it's hosted in Spain. It's a .com - Home | Costa Bemor : Promoción Construcción y Gestión Inmobiliaria

You could try contacting the hosting provider.
Their listing abuse[at]h3m.com for abuse reports.

Thanks Michele, I appreciate that. On a high level, what would I need to say to them regarding the legal consequences? That the site is infringing intellectual copyright law?

For the record, the site that's being ripped is Wall Estates and the culprit is Costa Bemor.

Well I've sent a final notice to the hosting company with a view to seeking legal advice on Monday morning. What a pain in the ass, having to go through all this trouble.
